Shoofly Olympic Sports Member Liability Waiver & Assumption of Risk

This Liability Waiver and Assumption of Risk ("Waiver") is entered into by the undersigned participant ("Participant," "you," or "your") in favor of Shoofly Olympic Sports, LLC, its owners, managers, employees, coaches, independent contractors, volunteers and agents ("Gym").

1. Acknowledgment of Inherent Risks

I understand that participation in fitness and athletic activities involves inherent and unavoidable risks, including but not limited to:

• Weightlifting, Olympic lifting, and use of barbells, dumbbells, kettlebells, racks, rigs ropes, boxes, bands, machines, and other equipment

• Boxing, contact or impact activities, and striking drills

• Group classes, specialty classes, clinics, competitions and events

• Independent workouts

• Use of shared or adjacent spaces

• Slips, falls, collisions with people or equipment, equipment failure, overexertion, dehydration, or improper use of equipment

• Actions or inactions of other participants

• Serious injury, permanent disability, paralysis or death

I understand these risks exist even when safety rules are followed and equipment is properly maintained.

2. Voluntary Participation & Assumption of Risk

I knowingly and voluntarily choose to participate in activities at the Gym. To the fullest extent permitted by North Carolina law, I assume all risks, whether known or unknown, foreseeable or unforeseeable, including risks arising from:

• The condition of the premises

• The actions or omissions of other participants

• The use of misuse of equipment

• My own physical condition or limitations

• The ordinary negligence of the Gym

3. Health Representation

I represent that:

• I am physically able to participate in exercise activities

• I have no medical condition that would make participation unsafe, or I have consulted a physician and received clearance

• I will modify or stop activity if I experience pain, dizziness, or discomfort

• I understand the Gym does not provide medical advice

4. Release of Liability for Ordinary Negligence

To the fullest extent permitted by North Carolina law, I release and discharge the Gym from any and all claims, demands, causes of action, or liability arising out of or related to:

• Personal injury or death

• Property loss or damage

• Participation in Gym activities or use of the facility

• The ordinary negligence of the Gym, including negligent acts or omissions related to instruction, supervision, programming, facility maintenance, equipment condition or emergency response

This release does not apply to gross negligence or intentional misconduct.

5. Emergency Medical Authorization

If I am injured or require medical assistance, I authorize the Gym to obtain emergency medical care on my behalf if deemed necessary. I understand that I am financially responsible for any medical treatment provided.

6. Data Privacy & Electronic Communication

I understand the Gym collects personal information necessary for membership, administration, safety, billing and communication. This may include contact information for participant, emergency contacts and participation records.

• The Gym will not sell my personal information to third parties

• Information is used only for Gym operations, safety and communication

• Records may be stored electronically and purged in accordance with federal and state laws

7. Email & Marketing Communications (Opt-Out)

I agree that the Gym may contact me via email, text message, or other electronic means regarding:

• Class schedules and programming

• Events and community announcements

• Membership and billing notices

• I understand that I may opt out of non-essential marketing emails at any time by using the unsubscribe link or by notifying the Gym via email at street@shooflyathletics.com

Transactional or safety-related communications may still be sent.

8. Photography & Media Release

I grant permission for the Gym to use photographs or videos of me taken during Gym activities for marketing or promotional purposes unless I notify the Gym via email at street@shooflyathletics.com that I opt out.

9. Governing Law & Disputes

This agreement is governed by North Carolina Law. Any dispute shall be brought in a court located in Wake County, North Carolina unless otherwise required by law.

10. Acknowledgment of Legal Rights

I acknowledge that I have read and understand this Waiver and that I am giving up certain legal rights, including the right to sue the Gym for injuries resulting from ordinary negligence. I sign this Waiver freely and voluntarily.

I agree that typing my name and the current date below serves as my legal electronic signature and indicates my full acceptance of the terms outlined in this agreement.
